Do sada se termin sezonski posao uglavnom odnosio na poslove tokom toplijih letnjih meseci. Kada čujemo “sezonski posao” obično prvo pomislimo na berbu malina ili posao konobara, promotera, radnika na građevini. 

Povremeni poslovi sa razlogom su popularni – idealna su prilika za sticanje iskustva onih koji iskustva nemaju (nisu radili nigde pre, studiraju). Na ovaj način se stiču radne navike, upoznaju novi ljudi, zarađuju, kako skromnije tako i ozbiljnije sume novca u zavisnosti od visine dnevnice. Dobre vesti su da se proširuje lista sezonskih poslova u Srbiji!

Novi zakon i novi predlozi

U najavi je donošenje novog Zakona o pojednostavljenom radnom angažovanju na sezonskim i drugim povremenim poslovima u Srbiji, na kojem će udruženo raditi Savez samostalnih sindikata Srbije i Ministarstvo za rad zapošljavanje, boračka i socijalna pitanja te se proširuje lista sezonskih poslova u Srbiji.

Tako bi poslodavac mogao evidentacionom prijavom da angažuje povremene radnike ne samo u građevinarstvu i ugostiteljstvu, već i u oblastima kreativne industrije, umetnosti zabave i rekreacije, kao i onim koje se odnose na čuvanje dece i odraslih ili održavanje higijene.

Na koga se nacrt novog Zakona tačno odnosi?

Odnosi se na pojednostavljene poslove u ugostiteljstvu – posao kuvara, konobara, perača sudova, šankera, barmena, sobarice, a u turizmu na turističke vodiče i pratioce.

Novi zakon uključiće i povremene poslove u sektoru komunikacija i informisanja umetnosti, zabave i rekreacije. Zakon će se odnositi na poslove privremeno angažovanih vozača, statista, rekvizitera, zatim u sektoru umetnosti – ljudi zaduženih za organizaciju događaja, postavljanje scenografije…

Šta se očekuje od poslodavca?

Poslodavac je dužan da pre stupanja na rad privremenog radnika upozna sa mestom, vremenom i načinom rada za određeni posao. Takođe je neophodno da zaposlenog upozna sa uslovima i tempom rada – kada se i koliko dugo obavlja posao, kada i koliko dugo može koristiti pauzu, slobodne dane, kolika će mu biti plata.  

Prema novom nacrtu Zakona poslodavac dostavlja evidencionu prijavu u elektronskom ili štampanom obliku i na taj način će se smatrati da je radnik saglasan sa uslovima rada kao i da je ugovor na taj način zaključen.

Preko posebnog informacionog sistema koji je povezan sa Poreskom upravom poslodavac je u obavezi da prijavi radnika. Za prepodnevnu smenu prijava se podnosi do 10 sati pre podne, a za popodnevnu između 13 i 15 sati.

Radno vreme je standardno – 8 sati, uz mogućnost prekovremenog rada – maksimalno do punih 12 sati. Isto tako radnik ima pravo na slobodan dan ukoliko je radio na dan koji pripada danima kada odmara.

Koga i na koliko dugo poslodavac može da angažuje za sezonski posao?

Povremeno poslove mogu da obavljaju ne samo nezaposlena lica već i zaposleni radnici koji rade nepuno radno vreme.

Posao je moguće obavljati najviše 15 dana mesečno za istog poslodavca ili ukupno 120 dana u toku iste godine. Svaki zaposleni ima pravo na pauzu od 15 do 45 minuta, ali nema pravo na godišnji odmor.

Poslodavac je dužan da:

  • Radniku plati sve poreze i doprinose
  • Plati nadoknadu za svaki radni sat

S druge strane radnik na povremenim poslovima i dalje je prijavljen na birou za nezaposlene i ne gubi prava na finansijsku podršku porodici ili pravo na porodičnu penziju.

Što se zdravstvenog osiguranja tiče, sezonski radnik ima prava isključivo u slučaju profesionalne bolesti ili povrede na radu.

I na kraju, ukoliko je poslodavac nezadovoljan radnikom u mogućnosti je da prekine angažman, ali je dužan da tom radniku isplati do tada neisplaćen iznos ugovorenih dnevnih neto naknada.
